Objective Resolution and Stability of Pakistan

OPINION: Every human has some purpose in his life and he spends all his abilities, energies and efforts to achieve his purpose. In the same way, there must be a “Purpose” in the life of a Nation also, to accomplish that A Nation must sow the seeds of its basic ideology in the soil of each aspect of life, for instance, Education, Law and Justice, Social structure, Customs, Cultural Values, etc.
An Islamic State is responsible for ensuring that its citizens have all their basic rights fully, easily and within the law. If we want to get the rights that Islam has given us, then we have to establish this ideal Islamic State in Pakistan that is proved by Sunnah and Hadith. 

 

We all know that with great efforts and sacrifices, under the shadow of the slogan of " LA ILLAHA ILLALLAH" we were blessed with “Pakistan”, Our Beloved Homeland, our national leaders and elders were able to get “Pakistan”, where they can live their lives according to Allah and Teachings of Islam.

Living our life according to Islam and its principles is settled as a basic goal of our nation. Therefore, when it was time to prepare the constitution of this country, Maulana Shabbir Ahmad Usmani, Sardar Abdul Rab Nishtar and Dr Ishtiaq Hussain Qureshi prepared a joint resolution of objectives. Which was approved by Prime Minister Liaquat Ali Khan on 21 March 1949. Under it, the principles on which the Constitution was to be prepared were laid down. Those principles are briefly as follows.

1.    “Whereas sovereignty over the entire universe belongs to Allah Almighty alone and the authority which He has delegated to the State of Pakistan, through its people for being exercised within the limits prescribed by Him is a sacred trust;

 

2.    This Constituent Assembly representing the people of Pakistan resolves to frame a Constitution for the sovereign independent State of Pakistan;

 

3.    Wherein the State shall exercise its powers and authority through the chosen representatives of the people;

 

4.    Wherein the principles of democracy, freedom, equality, tolerance and social justice as enunciated by Islam shall be fully observed;

 

5.    Wherein the Muslims shall be enabled to order their lives in the individual and collective spheres in accordance with the teachings and requirements of Islam as set out in the Holy Quran and the Sunnah;

 

6.    Wherein adequate provision shall be made for the minorities to[freely] profess and practice their religions and develop their cultures;

 

7.    Wherein the territories now included in or in accession with Pakistan and such other territories as may hereafter be included in or accede to Pakistan shall form a Federation wherein the units will be autonomous with such boundaries and limitations on their powers and authority as may be prescribed;

 

8.    Wherein shall be guaranteed fundamental rights including equality of status, of opportunity and before the law, social, economic and political justice, and freedom of thought, expression, belief, faith, worship and association, subject to the law and public morality;

 

9.    Wherein adequate provisions shall be made to safeguard the legitimate interests of minorities and backward and depressed classes;

 

10.  Wherein the independence of the Judiciary shall be fully secured;

 

11.  Wherein the integrity of the territories of the Federation, its independence and all its rights including its sovereign rights on land, sea and air shall be safeguarded;

 

So that the people of Pakistan may prosper and attain their rightful and honoured place amongst the nations of the World and make their full contribution towards international peace and progress and happiness of humanity.”

 

This resolution was included as a preamble in every constitution of Pakistan, even today it is an integral part of our constitution under Article 2(a). These objectives were set so that all laws in Pakistan are under the commandments of the Qur'an and Sunnah.

 

But, when we get our beloved Homeland, “Pakistan”, we adopted the same Colonial Era System as the condition of independence. We practically defied our “Purpose’. We made Criminal and Civil laws, and other Administrative laws with remains of Colonial Era law, that are certainly not Islamic. They are implemented in Pakistan with modifications.

Even the modified laws are not enforced in letter and spirit. Bribery, nepotism and other such termites have hollowed out our roots.

We take this freedom for granted. We should bring all laws and procedures in conformity with the teachings of Islam. Let’s create such an environment for the training of our people that they will gladly follow Islamic laws and bring their lives under Islam, our ultimate goal.

 

State and Islam should not be separated and the key principles of running the State should be derived from it.

The Western-style system that was introduced by the British Colonial Era to govern us, was adopted only out of necessity because at that time no law is made in the newly independent state.

If we make new laws under the influence of that colonial era, we will make more slave-minded people.

 An Islamic State is responsible for ensuring that its citizens have all their basic rights fully, easily and within the law. If we want to get the rights that Islam has given us, then we have to establish this ideal Islamic State in Pakistan that is proved by Sunnah and Hadith.
